HOur - TERMS OF USE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using HOur ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use HOur.

HOur is owned and operated by Nexa Labs, LLC ("Company," "we," "us," or "our").

2. DESCRIPTION OF SERVICE

HOur is a social photo-sharing application that sends hourly notifications prompting users to capture and share authentic selfies with friends. Photos disappear after 24 hours unless saved to Memories.

3. ELIGIBILITY

• You must be at least 13 years old to use HOur
• Users under 18 require parental consent
• You must provide accurate account information
• You are responsible for maintaining account security

4. USER ACCOUNTS

4.1 Account Creation

• One account per person
• Accurate and current information required
• You are responsible for all activity under your account
• Notify us immediately of unauthorized access

4.2 Account Termination

• You may delete your account at any time
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your content may be deleted

5. USER CONTENT AND CONDUCT

5.1 Your Content

• You retain ownership of photos you post
• You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and distribute your content
• This license ends when you delete content or your account (except content shared with others who haven't deleted it)

5.2 Content Rules

You agree NOT to post content that:

• Violates any laws or regulations
• Infringes intellectual property rights
• Contains nudity, violence, or graphic content
• Harasses, threatens, or harms others
• Promotes illegal activities or self-harm
• Contains hate speech or discrimination
• Impersonates others or is misleading
• Violates others' privacy

5.3 Authenticity Requirement

• Photos must be taken in real-time when prompted
• No uploads from camera roll during hourly captures
• Filters and heavy editing that compromise authenticity are prohibited
• Fake or misleading content will result in account action

6. HOURLY CAPTURE RULES

• Notifications arrive once per hour at random times
• You have 2 minutes to capture and post your HOur
• Late posts are marked as "Late"
• You cannot delete or edit posted Hours for 24 hours
• One retake allowed per HOur

7. PRIVACY AND DATA USE

Your privacy is important to us. Our Privacy Policy, incorporated by reference, explains how we collect and use your information.

8. INTELLECTUAL PROPERTY

8.1 Our Property

HOur's name, logo, design, and features are property of Nexa Labs, LLC. You may not copy, modify, or create derivative works without permission.

8.2 Copyright Infringement

We respect intellectual property rights. Report violations to support@itshourtime.com.

9. PROHIBITED ACTIVITIES

You may not:

• Reverse engineer or attempt to extract source code
• Use automated systems or bots
• Scrape or harvest user data
• Interfere with HOur's operation
• Bypass security measures
• Use HOur for commercial purposes without permission
• Create multiple or fake accounts
• Manipulate capture times or authenticity features

10. DISCLAIMERS

10.1 Service Availability

• HOur is provided "as is" without warranties
• We don't guarantee uninterrupted or error-free service
• Features may change or be discontinued

10.2 User Interactions

• We are not responsible for user conduct or content
• Use caution when interacting with other users
• We do not verify user identities

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Nexa Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use HOur.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Nexa Labs, LLC from any claims, damages, or expenses arising from your violation of these Terms or your use of HOur.

13. RATE LIMITING AND ABUSE PREVENTION

• Automated monitoring for abusive behavior
• Temporary restrictions for suspected violations
• Rate limiting to ensure service stability
• Appeals available through support

14. PREMIUM FEATURES AND PAYMENTS

If we offer premium features:

• Subscription terms will be clearly disclosed
• Payments are non-refundable except as required by law
• Auto-renewal unless cancelled before billing period
• Price changes with advance notice

15. MODIFICATIONS TO SERVICE AND TERMS

• We may modify HOur or these Terms at any time
• Material changes will be notified through the app
• Continued use constitutes acceptance

16. GOVERNING LAW AND DISPUTES

• These Terms are governed by Wyoming law
• Disputes shall be resolved in Wyoming courts
• You waive class action participation
• Claims must be brought within one year

17. SEVERABILITY

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

18. ENTIRE AGREEMENT

These Terms and our Privacy Policy constitute the entire agreement between you and Nexa Labs, LLC regarding HOur.
